Two recent California Department of Insurance investigations have resulted in the arrests of three San Jose citizens who reported car accidents for their insurance and supposedly misrepresented the facts to collect unearned insurance payouts. In the first instance, Ernesto Velasco, Sr., along with his son, Ernesto Velasco, Jr., were charged with multiple felony counts of insurance fraud after the department found that they had allegedly misrepresented information to an insurer regarding who had been driving a vehicle involved in a car crash. The Velascos’ claims led to a $4,888 reduction to the insurer. Cristina Pastrana was arrested on multiple felony counts of auto insurance fraud after allegedly misrepresenting data to an insurer asserting she was a motorist in an automobile collision.
