The State Corporation Commission (SCC) is proposing a security for Virginia consumers enrolled in managed care health insurance programs to guard against surprise bills from medical providers for figures not covered by their policy. Balance billing happens when out-of-network providers bill the patient to the supplier’s full charges beyond the amount covered by the insurance plan. The SCC’s Bureau of Insurance is proposing a regulation requiring managed care health insurance programs which the SCC regulates to demand an advance notice provision in each contract with all in-network facilities. As proposed, the regulation will require any hospital or medical facility in the health plan’s network to provide notice prior to admission or registration informing the patient if he or she could be handled and billed through an out-of-network provider. The notice has to be sufficiently timely to allow patients to decline the receipt of all services via an out-of-network provider at the center or contact the health program to seek and change to a different available in-network centre.
